Terms of Service

These Terms of Service ("Terms") govern your use of the BigCritCrew card submission service at sell.bigcritcrew.com (the "Service"), operated by BigCritCrew Investments ("BigCritCrew," "we," "us"). By creating a submission, uploading a card list, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service does
The Service lets you offer trading cards — currently Magic: The Gathering, Pokémon, and One Piece — for sale to BigCritCrew. You submit a list of cards; we provide a price estimate, review it, and may make you an offer to purchase some or all of the cards.
2. Quotes and offers
- Auto-quotes are estimates, not offers. The per-card figures shown when you build a submission are generated automatically from current market data and our buy rates. They are estimates and may change after human review.
- A binding offer is the reviewed quote we send you. Only a final quote that we issue after reviewing your submission constitutes an offer to purchase. We may decline any card or submission for any lawful reason.
- Offers expire. Each offer states a validity period. If you do not accept within that period, the offer lapses and pricing may be re-quoted at then-current rates.
3. Your cards — accuracy and ownership
- You represent that you own the cards you submit, that you have the right to sell them, and that they are authentic and described accurately (game, set, condition, and finish).
- We grade and verify cards on receipt. If a card's actual condition, identity, or authenticity differs materially from your submission, we may issue a revised offer for that card, exclude it, or return it.
- We do not purchase counterfeit, proxy, altered (unless disclosed and accepted), or stolen cards. Submitting such cards may result in forfeiture and reporting as required by law.
4. Shipping and risk of loss
Once you accept an offer, you are responsible for packing and shipping the cards to us in a manner that protects them in transit. Risk of loss remains with you until we receive and verify the cards, unless we have expressly provided a prepaid, insured shipping label and you used it as instructed.
5. Payment
- We pay after we receive and verify the cards and you have accepted the final offer.
- All payouts are made in cash via supported methods such as PayPal, Zelle, or ACH, or in person for local transactions.
- Payment processors are third parties subject to their own terms; we are not responsible for delays caused by a processor or by inaccurate payout details you provide.
6. Cards we decline
For cards we do not purchase, you choose at the time of submission how we handle them: return at your cost, donate to our community play stock, or process as bulk. If you do not respond to a request for instructions within a reasonable time, we may, after notice, treat unclaimed cards according to our then-current unclaimed-property practices.
7. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service and to sell cards to us.
8. Acceptable use
You agree not to misuse the Service — including by submitting fraudulent listings, automating abusive volumes of requests, attempting to disrupt the Service, or uploading content you do not have the right to upload.
9. Disclaimers and limitation of liability
The Service is provided "as is." To the fullest extent permitted by law, BigCritCrew disclaims implied warranties and is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability that cannot be limited under applicable law. Our total liability arising from a given submission will not exceed the amount we agreed to pay you for that submission.
10. Changes
We may update these Terms. Material changes take effect when posted with a new effective date. Submissions in progress are governed by the Terms in effect when the offer was issued.
11. Governing law
These Terms are governed by the laws of the state in which BigCritCrew operates, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law provides otherwise.
